7. Limitation of Liability

8. Force Majeure and Disaster Clause

  1. Horse Zone Platform shall not be held liable for any delay, suspension, or total or partial failure to perform any of its obligations arising from this contract if such delay or failure results from force majeure or circumstances beyond its control.
  2. Force majeure events shall include, without limitation, the following:
    • Natural disasters of all kinds (such as earthquakes, floods, storms, fires).
    • Epidemics, pandemics, and public health emergencies.
    • Wars, armed conflicts, security disturbances, or political unrest.
    • Governmental or judicial decisions or actions.
    • Power outages or interruptions to telecommunications or internet services.
    • Disruption or failure of electronic payment systems, banks, or technical service providers.
    • Major technical failures in the platform’s systems or servers beyond the reasonable control of Horse Zone Platform.
    • Any other events or circumstances beyond the direct control of Horse Zone Platform.
  3. Upon the occurrence of a force majeure event, all obligations of Horse Zone Platform affected by such event shall be suspended for the duration of the force majeure, without giving rise to any liability, compensation, or financial penalties against Horse Zone Platform.
  4. Under no circumstances shall the second party be entitled to claim any compensation, damages, loss of profits, or direct or indirect claims resulting from a force majeure event.
  5. Horse Zone Platform shall have the right, if the force majeure event continues for more than thirty (30) consecutive or non-consecutive days, to terminate the contract unilaterally without any legal or financial liability, provided that only the amounts for services already performed up to the termination date are settled.
  6. The second party shall remain fully responsible for all obligations owed to customers, governmental authorities, or any third parties related to the products, and the liability of Horse Zone Platform shall not, under any circumstances, extend to such obligations.
  7. The occurrence of a force majeure event shall not be considered a breach by Horse Zone Platform of any provision of this contract and shall not grant the second party any right to terminate the contract or suspend its obligations except to the extent expressly approved in writing by Horse Zone Platform.

9. Governing Law and Dispute Resolution

  • These Terms and Conditions are governed by and shall be interpreted in accordance with the laws of the State of Kuwait.
  • In the event of any dispute arising from the use of the website or the interpretation or enforcement of these terms, the courts of Kuwait shall have exclusive jurisdiction.

10. Amendments

  • Horse Zone reserves the right to modify or update these Terms and Conditions at any time. Any changes will become effective upon their publication on the website.
  • Your continued use of the website after such updates constitutes your explicit acceptance of the revised terms.

11. User Acknowledgment
